Terms and Conditions of Use

These Terms and Conditions of Use (the “Terms”) govern access to and use of the Fullcarro website and applications (the “Platform” or the “Site”), operated by Fullcarro, with contact channel [email protected]. By accessing, browsing, registering or using the Platform, the user (the “User”) states that they have read, understood and accepted these Terms, which are binding. Anyone who does not agree must not use the Platform.

1. What Fullcarro is

Fullcarro is a marketplace: a virtual storefront of classified vehicle listings that connects buyers and sellers so they can negotiate and contract directly with each other. Accordingly, and expressly, Fullcarro:

  • Does not own the listed vehicles, does not possess them, and does not offer or sell them.
  • Is not a seller, buyer, dealer, broker, agent or middleman in the transactions.
  • Charges no commission on sales and does not participate in the price agreed between the parties.
  • Does not take part in the negotiation, payment, delivery, title transfer or closing of the deals between Users.
  • Does not guarantee the existence, quality, condition, year, mileage, origin, legal status (liens, holds, tickets) or legality of the listed vehicles, nor the truthfulness, accuracy or currency of the information posted by Users.

The relationship between buyer and seller is direct and independent of Fullcarro. Fullcarro is not a party to any transaction between Users and assumes no obligation arising from them.

2. Eligibility

The Platform is intended for adults with legal capacity to contract. By registering, the User states that they are of legal age and have such capacity. Anyone registering an account on behalf of a company states that they are authorized to bind it.

3. Registration and account

To post listings or use certain features, the User must create an account with truthful, accurate and current information. The User is responsible for keeping their credentials confidential and for all activity from their account. There is a single account type: a private User can buy and sell, and anyone who needs to can activate a professional (dealer) account, subject to additional features and plans. Fullcarro may suspend or cancel accounts that breach these Terms.

4. Posting listings

The User who posts a listing (the “Seller”) is solely responsible for its content and states:

  • That the vehicle information is accurate, truthful and current.
  • That they own the vehicle or are authorized to sell it.
  • That the photos correspond to the vehicle offered.
  • That the price is expressed in U.S. dollars and includes taxes where applicable.

Each listing corresponds to a single (1) vehicle. Misleading listings, listings with false information, of vehicles of unlawful origin, or that violate the law or these Terms are prohibited. Fullcarro reserves the right to edit, decline to publish, suspend or remove any listing that does not meet its policies, without notice and without creating any liability or right to compensation.

5. Free of charge and plans

Posting and using Fullcarro's basic features is free, and Fullcarro charges no sales commission. Fullcarro may offer optional paid professional plans or services (for example, for dealers), processed through third-party payment gateways. The conditions, prices and term of such plans are disclosed at the time of purchase. Except where required by law, payments for services already provided are non-refundable.

6. Relationship between Users and assumption of risk

Negotiations, agreements, payments and deliveries take place directly and exclusively between buyer and seller, at their own responsibility and risk. Fullcarro recommends acting prudently: verify the other party's identity, the documentation and the actual condition of the vehicle (inspection, title, liens, ticket check) before making any payment. Fullcarro is not liable for transactions based on trust placed in the Platform.

7. Limitation of liability

Fullcarro provides the Platform “as is” and “as available.” To the maximum extent permitted by law, Fullcarro shall not be liable for:

  • The listed vehicles or the transactions between Users (existence, quality, condition, legality, performance, payment or delivery).
  • The truthfulness or accuracy of information posted by Users or third parties.
  • Damages, losses, lost profits or harm arising from the use of, or inability to use, the Platform.
  • Technical failures, interruptions, errors, viruses or Internet problems beyond its control.
  • Content or services of third-party sites linked from the Platform.

8. User conduct

The User agrees to use the Platform in accordance with the law and these Terms. Prohibited, among others: posting unlawful, false or misleading content; impersonating others; breaching security or databases; extracting data automatically (scraping); and using the Platform for fraudulent purposes or to send unsolicited communications.

9. Enforcement

Without prejudice to other measures, Fullcarro may warn, temporarily suspend or permanently disable the User, and remove their listings, when they breach the law or these Terms, or when their conduct could create liability for themselves, for Fullcarro or for third parties.

10. Intellectual property

The Platform, its software, design, trademarks, logos and content are the property of Fullcarro or its licensors and are protected by intellectual property laws. Their unauthorized reproduction or use is prohibited. By posting content (text, photos), the User states that they hold the rights and grants Fullcarro a free, non-exclusive, worldwide license to host, display and distribute it on the Platform and in its promotion.

11. Data protection

The processing of personal data is governed by the Privacy Policy and the Data Processing Consent, which are an integral part of these Terms.

12. Changes

Fullcarro may modify these Terms and the Platform at any time. Changes take effect upon posting. Continued use of the Platform means acceptance of the current Terms.

13. Termination

The User may stop using the Platform and request deletion of their account at any time. Fullcarro may suspend or terminate the service in accordance with these Terms.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and by the applicable federal laws of the United States. This does not limit any mandatory consumer-protection rights the User may have under the laws of their state of residence.
